Terms of Service

1. Acceptance of Terms

By accessing or using Cited ("the Service"), operated by Cited at cited-app.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all visitors, users, and others who access the Service.

2. Description of Service

Cited is a software-as-a-service (SaaS) platform that tracks whether AI engines (including ChatGPT, Claude, Perplexity, and Gemini) mention or recommend your business in response to user queries. The Service provides citation scores, trend analysis, competitor tracking, and optimization recommendations.

3. Acceptable Use

You agree not to use the Service to:

• –Violate any applicable law or regulation.
• –Track brands, businesses, or individuals without authorization.
• –Attempt to reverse-engineer, scrape, or abuse the Service or its underlying APIs.
• –Interfere with or disrupt the integrity or performance of the Service.
• –Transmit any malware, viruses, or other harmful code.
• –Use the Service for any unlawful competitive intelligence purposes.
• –Resell or sublicense the Service without prior written consent.
• –Create multiple accounts to circumvent plan limits.

We reserve the right to terminate accounts that violate these rules without notice or refund.

4. Subscriptions and Billing

Cited offers free and paid subscription tiers. Paid plans are billed monthly or annually through Paddle, our payment processor and Merchant of Record.

• –Monthly plans are billed each calendar month on the date you subscribed.
• –Annual plans are billed once per year at a discounted rate.
• –Your subscription renews automatically at the end of each billing period unless cancelled.
• –You may cancel your subscription at any time from your Settings page.
• –Upon cancellation, you retain access to paid features until the end of your current billing period.
• –We reserve the right to change pricing with 30 days notice to active subscribers.

5. Refund Policy

Monthly plans: We do not offer refunds on monthly subscription charges. You may cancel at any time to stop future charges.

Annual plans: If you cancel an annual plan within 14 days of the start of a billing period and have not made substantial use of the Service during that period, you may request a prorated refund for unused months. Refund requests must be submitted to [email protected] within 14 days.

All refunds are at our sole discretion. We will not issue refunds for accounts terminated due to violations of these Terms.

6. AI Engine Disclaimer

The Service works by querying third-party AI engines (OpenAI, Anthropic, Google, Perplexity AI). We have no control over the responses these engines produce, and their outputs may change at any time without notice.

Cited reports what AI engines say in response to specific prompts at a given point in time. We make no guarantee that:

• –AI engines will mention or recommend your business.
• –Citation scores will improve as a result of following our recommendations.
• –AI engine responses will remain consistent between checks.
• –The data we collect is a complete representation of all AI engine behavior.

We are not affiliated with, endorsed by, or responsible for OpenAI, Anthropic, Google, or Perplexity AI.

7. Intellectual Property

The Service, including all software, design, text, and data, is owned by Cited and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your own business purposes. You may not copy, modify, distribute, or create derivative works from any part of the Service.

You retain ownership of the data and content you provide to the Service (your business name, prompts, etc.). By using the Service, you grant us a limited license to use that data solely to provide the Service to you.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Cited and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, arising out of or in connection with your use of the Service.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the three months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Account Termination

You may delete your account at any time from your Settings page. Account deletion is permanent and removes all associated data within 30 days.

We reserve the right to suspend or terminate your account immediately, without notice or refund, if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or in-app notice at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Israel.
